Announcement Regarding EC 1907/2006 REACH Regulation, One of the Most Important Criteria for CE Certification in Fertilizers

 

As of July 16, 2022, one of the key requirements of EU 2019/1009 (FPR) regulation, which came into effect in the European Union, is the registration obligation of raw materials under the scope of REACH.

 

What is REACH?

 

REACH (Registration, Evaluation, Authorisation, and Restriction of Chemicals, (EC) No 1907/2006) is a comprehensive regulation encompassing many regulations related to chemicals in the European Union. REACH stands for the Registration, Evaluation, Authorization, and Restriction of Chemicals.

 

Article 26 of the FPR Regulation states:

 

"When an EU fertilizer product contains a substance or mixture under Regulation (EC) No 1907/2006, its safety for the intended use of its components must be registered according to this regulation."

 

What does this mean? The FPR Regulation states that components in Component Material Categories (CMC) listed in Annex II must comply with FPR, including cases where they are produced or imported in quantities below 1 ton per calendar year under EU REACH. Additionally, please note that some of the registration exemptions specified in REACH Annex V do not apply under FPR.

 

Furthermore, to demonstrate the safety of the "intended use" for products intended for other soil or plants, it is important to note that for most CMCs, the information requirements for REACH registrations under Annex VII (1 - 10 tonnes per year) apply. Specifically, for registrations falling within the 1 - 10 tonnes per annum range, it is worth mentioning that the information requirements of REACH Annex VIII (10 - 100 tonnes per year) are applied.

 

To ensure that their fertilizer products comply with FPR, manufacturers should:

 

Verify the compliance of all components used in their fertilizer products (including all auxiliary substances) with the CMCs listed in Regulation (EU) 2019/1009.

 

If a specific component is in compliance with CMC 1, 3, 4, 5, 6, 8, 9, 10, 11, 12, 13, 14, and 15, a REACH registration may be required.

Evaluate relevant components to determine whether auxiliary substances are supplied from REACH-registered supply chains.

Research whether any of the existing exemptions apply to substances not supplied from REACH-registered supply chains.

Remember that FPR may invalidate certain existing REACH registration exemptions.

For substances already registered under REACH, confirm with your supplier whether the registration meets the information requirements of the FPR Regulation.

Prepare a compliance strategy for substances requiring registration under REACH to ensure compliance with Regulation (EU) 2019/1009, i.e., FPR."
